Terms of Use

This document is a legal agreement between you and Grrafix that governs the use of this web site.

By contributing or downloading photos or images on this web site you affirm that you have understood and agreed to all terms and conditions in this agreement and elsewhere as applicable on this web site. Should you disagree with anything in this agreement please stop using this web site and delete whatever you may have downloaded from it.

1. Definitions

'You' means yourself or third parties acting for you.

'Grrafix' means its officers, its web site and content and photos therein.

'Photos' mean photos, illustrations, images.

2. Contributing Photos to Grrafix

You confirm that you are the copyright holder of the photosyou send to Grrafix and that the photos are free for anyone to use.

You understand that anyone may download your photos from Grrafix for personal or commercial purposes. If you wish, however, you can stipulate how your photos are used via a Creative Commons licence.

If your photos show people recognisable as individuals or show copyright property, you agree to provide model releases or property releases, if you have them, to anyone who may need them to make use of your photos.

3. Using Photos on Grrafix

All photos on Grrafix are free for personal or commercial use. You may use the photos on web sites, multimedia presentations, broadcast film and video, in books, newspapers, magazines, brochures, flyers, printed promotional materials, etc.

However, use of photos is not always straight forward because copyright law can be vague, tangled and different for each country. It is up to you to ensure that any photos on Grrafix that you use can be used legally. If it is found that any photos are not actually available for free use, you must be prepared to stop using these photos. You use photos at your own risk (see 7. Limitation of Warranty).

Although photos are free, the use of some photos is subject to how they are used. The owners of some photos may have placed a Creative Commons licences on them. Please check photos for mention of any Creative Commons license that governs how you use them.

When using an image on Grrafix that may need a model release or property release it is up to you to obtain the document from the photographer. You must satisfy yourself that you have secured all necessary permissions that may be required for using the photo.

4. Restrictions

You may not use any photo on Grrafix in a way that may be considered offensive, indecent, libellous, pornographic or unlawful, or to endorse works of an anti-animal liberation nature.

You may not use any photos on Grrafix to compete with Grrafix on a web site that is wholly or partially given to displaying photos.

You will download photos manually from Grrafix, not by bulk downloader, automated software or by other means.

5. Attribution

You will show each photo from Grrafix that you use in a professional editorial or related context with a legible credit to the photographer if known and to grrafix.com.

6. Indemnification

You will fully indemnify and hold harmless Grrafix and all Grrafix's associates from any and all claims, demands, liabilities, costs, losses, damages, and expenses, howsoever incurred, in connection with your use of Grrafix material.

7. Limitation of Warranty

Grrafix does not guarantee or warrant that its content and photos are free from defects, omissions, viruses or other harmful factors, or that information on this site and about its photos is accurate or reliable, or that Grrafix will correct them. All risk, cost and responsibility using photos, information and content on this site are yours entirely and you shall not hold Grrafix liable for any problems that may arise. You may see on Grrafix offensive material and only you are responsible for continuing to view it and for using it.

8. Privacy Policy

When you register with Grrafix we only use your information for replying to your enquiries and for record keeping. Should someone wish to email you, we will ask your permission first. We do not sell or trade personal information to any party.

9. Other

The laws of England and Wales shall govern these Terms of Use.

Grrafix may end and delete your account in the case of misuse of Grrafix services or facilities.

Grrafix reserves the right to revise or terminate these Terms of Use, licence terms, prices, information and other material on the Grrafix web site and terminate the web site without notice.
